Late Delivery
In the event that the Carrier does not deliver the merchandise or materials at the designated delivery point, on the day and time indicated by Fr8App, the Carrier undertakes to pay Fr8app the expenses generated by the late unloading of the merchandise, an amount that, in accordance with the agreement between the Parties, Fr8app may offset against the Consideration that is pending settlement.
Unloading the Unit
The Carrier agrees to turn off the equipment's engine while unloading maneuvers are being carried out.
The Carrier agrees to immobilize the equipment prior to unloading by placing chocks.
The Carrier agrees to provide the Client's personnel with the key to the equipment, in order to ensure that it is immobilized during unloading maneuvers.
In the event that the Carrier fails to comply with any of the provisions established in this clause, the Carrier shall be liable for any loss, damage, or injury to Fr8App and its Clients during the contracted Service. The Carrier shall consider the value of the merchandise and materials transported. The Carrier expressly waives any liability limits, including, but not limited to, those set forth in Article 66 of the Federal Law on Highways, Bridges, and Federal Motor Transport.
Unloading Maneuvers
The Carrier must ensure that they check and confirm whether the contracted transportation service includes or excludes unloading maneuvers and their respective conditions.
If the contracted transportation service includes unloading maneuvers, the Carrier will be solely responsible for carrying out said unloading, and therefore any damage to the Client's equipment or facilities will be the Carrier's responsibility.
The risk of loss or damage to the merchandise will remain with the Carrier until confirmation of delivery to the Client.
If the Client is responsible for unloading the merchandise and causes any damage to the Carrier's equipment during unloading, the Client will be responsible for the cost of the corresponding repairs. In order to implement this guideline, the Carrier must immediately formally notify Fr8App of this situation so that the corresponding procedures can be initiated.
In the event that the unloading by the Client takes more than thirty (30) minutes from the time the Carrier has reached its destination, the Carrier must notify Fr8App immediately.
Accrual and Approval of Accessories
Payments for extraordinary costs due to maneuvers, infractions, delays, or any service requirements necessary for the continued provision of the Services that are not included in the rates agreed upon in the Rate Confirmation of shipment:
- Must be reported within 24 hours of accrual.
- They are subject to written request and approval by Fr8App.
All information regarding ancillary costs can be found in detail in our Ancillary Charges Policy for Carriers.
Locks, Seals and their Evidence
The Carrier must follow our guidelines on Fleet Security Equipment.
The Carrier must ensure that the goods have the necessary locks and are properly sealed after loading the unit, during transit, and upon arrival at the Customer's destination.
The Carrier must capture evidence of intact seals and locks upon arrival at the destination and share it with Fr8app before unloading by the Customer.
Fr8App has a Green Light Arrival Protocol (LVLL), which includes a checklist of post-route checks. The objective of this protocol is to ensure optimal security conditions after transit, and compliance with this protocol is mandatory for the Carrier. This protocol verifies and compiles, among other things, the correct reception and storage of evidence of intact locks and seals after the route.
Fr8App has a Carrier Internal Audit Program (PAIC), which constantly conducts random audits of active shipments in the system. Various parameters are unannounced to ensure our carrier base is up to date. The proper reporting and storage of locks, seals, and evidence is one of the elements audited.
The Carrier agrees to participate in the PAIC if requested. Furthermore, independently of the PAIC, the Carrier agrees to provide Fr8App, upon request via email, with a copy of all the documents mentioned in this section within two (2) calendar days of the request.
In the event that the Carrier fails to comply with any of the provisions set forth in this clause, the Carrier shall be liable for any loss, damage or harm to Fr8App and its Clients during the contracted Service, taking into account the value of the merchandise and materials transported and the Carrier expressly waiving any liability limits, including but not limited to those set forth in article 66 of the Federal Law on Roads, Bridges and Federal Motor Transport.
Compliance Documentation
Signature Responsibility
At the end of each shipment, the Carrier is obligated to obtain the signature, name, and seal of the person receiving the goods or materials from the Client at:
- Shipment Control.
- Bill of Lading.
This signature must explicitly attest that the respective shipment was carried out in accordance with the provisions of the corresponding contracts, service orders, and bills of lading between Fr8App and the Client.

Completed Trip Report
The Carrier agrees to download the information for each trip completed (e.g., speed reports, GPS, weight sensors, if applicable, drug reports, etc.) for its records, as well as send a copy of said information to Fr8App.
