Introduction to the Fr8App Security Protocol
Dear Carrier,
Welcome to Fr8App, we are very pleased to have you as a strategic partner.
In the following articles you will find a summary of the main commitments made with Fr8App in the area of security and monitoring, both preventive and reactive.
Our Security Protocol establishes the operational security guidelines so that our collaborating carriers integrated in Fr8App can provide the transport of goods to our clients.
We ask that you consult this Security Protocol in detail when starting our business relationship, make sure that your entire operation is aware of it and has it easily located for a correct execution of the security protocols in case of an event.
Definitions
Throughout the Security Protocol, we will use the following terms:
- The Shipper. We refer to the companies that hire Fr8App to act as intermediaries in the transfer of their goods.
- Fr8App. We refer to our company, Freight App de México, S.A. de C.V.
- The Carrier. We refer to the transport company hired by Fr8App to provide a logistics service.
- The Parties. In this case, we refer to the Fr8App - Carrier binomial.
- The Services. We refer here to the different logistics services contracted by Fr8app to the Carrier to carry out the correct transport of the Client's goods.
- The Consideration. We refer to the economic amount agreed as payment from Fr8app to the Carrier for the provision of the contracted logistics service.
- The Collaborators. We refer to all those parties involved in the contracted service provided by the Carrier, such as: its dispatchers, its monitors, its operators, etc.
- The Teams. We are referring here to trucks, tractor-trailers, trailers, converters and, in general, any motor or cargo vehicle through which the Services are provided.
General Terms of Service
The Carrier acknowledges and agrees that Fr8App is a transportation intermediary and, therefore, subcontracts the various transportation and logistics services to the Carrier.
The Carrier shall be responsible for all acts and/or omissions of its Collaborators in the provision of the contracted services, as the Carrier is solely responsible to Fr8App.
The Carrier undertakes to provide the Services with the utmost diligence and quality, as well as to comply with all applicable legal provisions and the rules recommended by science and technology. Furthermore, the Carrier undertakes to comply at all times with the provisions of the Commercial Code, the Federal Highways and Bridges and Motor Transport Law, the Traffic Regulations on Highways and Bridges under Federal Jurisdiction, the Regulations on the Weight, Dimensions, and Capacity of Motor Transport Vehicles that Utilize Highways and Bridges under Federal Jurisdiction, the Transportation and Traffic Regulations of the various states, the Mexican Official Standards (NOM), and other current legislation applicable to the Services.
The Carrier undertakes to comply with all applicable safety and hygiene measures, including, but not limited to, the Federal Labor Law, the Regulations of the Federal Labor Law, and the Mexican Official Standards issued by the Ministry of Labor and Social Welfare.
The Carrier will provide Fr8App with the advice it requests, in relation to and in compliance with the provisions of Fr8App's quality standards, the Commercial Code, the Federal Roads and Bridges and Motor Transport Law, the Traffic Regulations on Highways and Bridges under Federal Jurisdiction, the Regulations on the Weight, Dimensions and Capacity of Motor Transport Vehicles that Transit on Roads and Bridges under Federal Jurisdiction, the Transportation and Traffic Regulations of the different federal entities, the Mexican Official Standards (NOM) and other current legislation that is applicable to the Services.
The Carrier shall be responsible for ensuring that its Collaborators comply with each and every one of the terms and conditions of this Safety Protocol during the provision of the contracted services. Therefore, the Carrier shall be liable for any non-compliance by its Collaborators.
The Carrier undertakes to send Fr8App the operator and unit assignment schedule in a timely manner, with sufficient time for said information to be entered into the system and analyzed by our teams to ensure the monitoring and safety of the shipment en route.
The Carrier will receive the merchandise in question at the place, day, and time indicated by Fr8app, and undertakes to initiate and complete the transport within the timeframe, routes, terms, and conditions indicated in our Rate Confirmation.
The Carrier shall be responsible for the merchandise it transports, from the moment it is received by the Carrier and throughout the entire journey of the assigned route, until it is delivered to the Shipper.
By accepting the Rate Confirmation, the Carrier expressly waives any liability limits for the merchandise, including but not limited to the limits established in Article 66 of the Federal Law on Roads, Bridges and Federal Freight Transportation and in any Bill of Lading issued in the performance of services.
